Capital Gains Tax Changes

Capital gains tax as it pertains to home sales may change with new tax package. Both the House & Senate tax plans call for homeowners to live in their home for 5 of the previous 8 years to avoid paying a capital gains tax on any profits. Currently, the law calls for home sellers to live in their home for 2 of the previous 5 years to avoid a capital gains tax. The taxable gain amount stays the same at $250,000 for an individual of $500,000 for a married couple.

The senate version of the tax reform bill contains a provision where if home owners are under contract prior to Jan 1st 2018 even though they may not close the sale until some time in 2018, the former time frame for tax exemption will apply.

It’s too soon to tell which version gets to the president’s desk if any, but if you’ve owned your home for less than 5 years but more than 2 and are contemplating selling, now is the time. It is still possible to to get your home listed and under contract. Possibly even close the sale if we can secure a cash buyer.

Have you or your parents been holding onto SW Florida property with no intention of ever using it? The time to sell it is now while the owners are alive and of sound mind. The property may not be worth a whole lot of money, assuming it’s vacant land not on gulf access canal, but the expense associated with trying to sell it after it has been left to heirs via a will, may likely eat into the value by far too much.

Florida is a probate state. Property left to an heir by will must be probated by the courts prior to any transfer of ownership taking place.

I’m currently working on a situation now where the market value is $6500 however the property was never probated after it was left to the heirs in the will. About $1500 in charges is now necessary to get the property through probate.

If you have vacant land in Cape Coral or Lehigh Acres that you never intend to use, and you’re getting along in years and plan to give the land to your children or others after your death, please do them a favor, and sell it now. You can always give them the cash after your death if you wish. They will appreciate it much more than hiring an attorney to probate the property before they can sell it.

  1. Home buyers decide to not buy your home before they ever see it in person.

Let’s face it, virtually no one buys a home site unseen. What sellers don’t realize however is that more than 90% of all buyers shop homes online. Now they may not decide to buy your home after only viewing it online, however they do decide NOT to buy your home after only viewing it online.

Case in point. Three of my last four buyers viewed less than 4 homes in person before entering into a contact to buy one of them. They weren’t uninformed buyers! They performed their due diligence online and didn’t waste time viewing homes in person that didn’t meet with their approval online. The quantity and quality of your online presence matters more than you know!

  1. When buyers actually visit your home in person, it’s just a commodity to them. A house if you will, but not a (their) home. Buyers establish an emotional connection to your house (now seeing it as their home) once they decide to sign their names to an offer to purchase. Never before though.
  1. Buyers who view you home in person, know in less than 5 minutes from arriving that they do not want to buy your home. 
  1. Buyers almost never offer as much for your home as they are willing to pay. They offer what they hope you might accept. How much they are willing to pay can only be determined after an effective negotiation. (If you’re not an experienced, highly effective negotiator who knows the local market inside and out, hire a Realtor who is.)
  1. Buyers are uncomfortable getting a feel for your home, when you are present during showings. Oh they may be polite, but they can’t wait to get out of there so they can say to their agent “wow that was weird”. Hint: if you must let them in, take a walk down the street so they can get a feel for your house to see if it might suit them as their home. Buyers shop within a range of specifications, but they buy based on emotion. It has to FEEL right!

7  Things Buyers Can Expect at an Open House

Home Buying Tips SWFLTouring homes can be one of the better parts of the home buying process. For a brief moment you can envision your life in what might be your new home! Still, stepping into someone else’s home, especially during an open house, can be intimidating. Here’s what you can expect:

1. To be asked to sign in.
The agent will ask you to sign in with your contact information so he or she can follow up. Of course you are free to decline.

2. To remove your shoes.
After all, the homeowners has worked hard to make the place sparkle. Tracking dirt onto the carpet or hardwood destroys their effort.

3. (Not) to meet the seller.
Sellers working with an agent usually leave during open houses. This provides you the opportunity to explore free from the distraction of a hovering owner.

4. To scope out the competition.
The number of other people touring the home (and the amount of traffic throughout the day, which you can track on the sign-in sheet if you visit on the late side) can give you a good indication of the level of interest in the property.

5. To wait your turn.
If there are several groups during your visit, wait for them to leave a room before you enter. It’s a great chance to eavesdrop as they may ask the Realtor questions you hadn’t thought of, or comment on features you might not notice yourself.

6. To meet the neighbors.
Chances are, they’ll stop by for a peek. Ask them about the neighborhood. They’re the experts, after all.

7. To hold your tongue.
The Realtor will most likely ask you questions about your home search. Be savvy about what you reveal. Don’t give away any information that could compromise your bargaining power.

Should home buyers call the listing agent when making a home purchase?

The short answer is NO!

Cape Coral Home Buying TipsBeyond that, let me start by stating the obvious, that all real estate professionals are not created equal. While you certainly may end up dealing with an agent who is helpful and honest, he or she has made a commitment to represent the seller’s best interest in the sale of their home.

It’s like going to court and using the other side’s attorney. Think about it, you just wouldn’t do it! Oh sure, a few buyers believe that if they deal directly with the listing agent, that they will be able to get the home for a lower amount because the agent will reduce their commission with not needing to pay a cooperating broker. While this may occur, don’t count on it! Though regardless, there is still no experienced real estate pro protecting your interest.

In all honesty, many buyers don’t have any idea the ways in which a good experienced real estate professional looks out for their interest in a contract negotiation. Most buyers think that the price is about the only thing in play. Wrong! Every real estate transaction is about price and terms, including timelines for inspections, appraisal, loan approvals etc. My experience tells me that all buyers need guidance. Even those who don’t think they do. Sometimes especially those who don’t think they do!

Bob Ashworth photo cardIn addition, effective negotiating takes practice. Most people buy or sell one or two, maybe three homes in a lifetime. A full time real estate professional is writing and negotiating real estate contracts every week. If you have your thumb on the pulse of the market and negotiate dozens to hundreds of deals every year, go ahead and make an offer with the list agent. Otherwise, tap into the experience of a good buyers agent assist you with your real estate purchase. The best agents of course are the ones who list and sell homes as well as work with buyers to make a purchase. For instance, I use my experience with buyers on other listings to counsel my sellers on the current mindset of the buying public, and vice versa.

As an added bonus, in virtually all cases, including shopping for a builder to build your new construction home whether it be on your own lot, a lot you purchase, or a home in a developing community; your agent’s commission will be paid by the seller, or builder as the case may be. What many people fail to realize is that the Multiple Listing Service or MLS, is the greatest networking platform ever devised. All Realtor listings get uploaded into the MLS by the listing agent, with a cooperating commission amount clearly displayed to any and all other Realtor’s in that area. While the listing agent may not yet have a buyer for that new listing, maybe one of the thousands of agents associated with the MLS is already working with a buyer looking for a home just like that.

So the next time you are going to buy a home, commit yourself to working with a good experienced Realtor. If it’s SW Florida where you’re buying, I’ll be happy to help you. My pledge is that I will never try to sell you a home; I’ll help you buy one. The one that is right for you and your budget.

All of the legal filings, depositions, investigatory work etc. Mr. Morgan claims that he will do all the work necessary to reach successful conclusion to your case, or you owe him nothing!

Everyone want to know how long it takes to sell a home!

I get asked a lot – How long will it take to sell my home? or What is the average days on the market to sell a home?

Homes for Sale Cape Coral FLWhat is the average days on the market? Is a question on most sellers minds prior to listing their home for sale.

They confuse 90+/-  days of average time on market with meaning that most homes, or more importantly their home will take 90 days to sell. 90 days average means that many homes (the ones that were priced right) sold in the first 2 to 4 weeks on the market, however many others sat on the market unsold for 4, 5, or 6 months or more, which then helps comprise the average days.

If the Realtor that you are interviewing concurs that the average days on the market are, whatever they are, and that yes you should expect to sell in and around that time frame, you need a different Realtor!

Besides who wants average anyways?

Home ValueHere’s the bottom line. A home that is priced right for the current market, well exposed and marketed with good quality photo’s and a virtual tour, should expect to be under contract, or pending sale as some call it, within the first 2-6 weeks max on the open market.

In most markets and certainly here in my market in SW Florida, Cape Coral, Fort Myers and Lee County there is a large pool of buyers anxiously waiting for the right home for them to come on the market. Most buyers do their due diligence of visiting many homes before making a purchase decision. So the supply of homes that is on the market and therefore “unsold” for one reason or another, has been vetted by the pool of buyers. When we list a new home for sale that is priced right, boom! The pool of buyers immediately notice the new listing. If we hit the price right, multiple showings will begin and offers to purchase will follow.

The bottom, bottom line! Most sellers are unwilling to accept what the true value of their home is when they first list it for sale. So, we list a little higher than we should, then after 4-8 weeks when the seller begins to realize that maybe it’s priced higher than the buyers are willing to pay, they agree to reduce it. Homes are not like beef or wine. They don’t need an aging process to make them more enjoyable or desirable.

How many days will your home be on the market? Well that’s entirely up to you.
